Online Divorce

Online Divorce

If you live abroad and want to get a divorce in Pakistan, the process requires proper planning and documentation. One important step is appointing a Special Power of Attorney (POA) in Pakistan to act on your behalf.

This allows your representative to handle all legal formalities, including sending the divorce notice to your spouse and completing the required paperwork. With the right guidance, overseas Pakistanis can manage the divorce process efficiently and legally without being physically present in Pakistan.

Divorce by Husband (Talaq)

The word divorce comes from Latin divortium, meaning separation. A person who is divorced is called a divorcee.

Under Muslim law, a marriage can end by the death of a spouse or by divorce. When initiated by the husband alone, it is called Talaq. Divorce can also occur by mutual agreement, known as Talaq-e-Mubarat.

In Islam, the husband can pronounce Talaq verbally, which is recognized under Sharia law. However, in Pakistan, a written Talaq Nama in Urdu or English must be submitted and registered with the relevant authority, such as the Union Council or Arbitration Council. For overseas Pakistanis, this can be done through a Special Power of Attorney.

These steps are essential for a valid divorce under Pakistani law.

Divorce Procedure for Overseas Pakistanis

Overseas Pakistanis can complete divorce procedures from abroad without traveling to Pakistan. Wives can seek online Khula, and husbands can send a divorce notice and obtain a NADRA Divorce Certificate remotely.

Step-by-Step Procedure

Consult a Lawyer & Create a Special Power of Attorney (SPA):
Appoint a representative in Pakistan (lawyer or family member) through a Special Power of Attorney. This allows them to file divorce documents and obtain the divorce registration certificate on your behalf.

Attestation of SPA:
The SPA must be signed by the principal (the person abroad), attested by the Pakistani embassy, and then attested by the Ministry of Foreign Affairs in Pakistan.

Prepare and Sign the Talaq Nama (Divorce Deed):
The husband drafts the Talaq Nama, which is sent to the authorized representative. The representative submits it to the Union Council where the marriage is registered or where the wife resides.

Union Council Submission & Waiting Period:
The Union Council starts a 90-day reconciliation period. If reconciliation fails, the divorce is finalized, and NADRA issues the official Divorce Certificate.

Form of Online Divorce in Pakistan

The law under The Muslim Family Laws Ordinance 1961 allows divorce, but there is no specific form or words required. The husband does not need to state a reason, as long as his intention to divorce is clear.

Documents Required for Online Divorce
  • Valid ID: CNIC for Pakistanis; Passport or foreign ID for overseas Pakistanis.

  • Nikah Nama: Marriage certificate or registration document.

  • Divorce Deed: Properly written Talaq Nama on stamp paper.

  • Duly Attested SPA: Attested by Pakistani embassy and Ministry of Foreign Affairs.

Conditions for a Valid Online Divorce
  • The words of Talaq must clearly show the husband’s intention to end the marriage.

  • The husband must be sane and legally competent (above puberty).

  • Consent must be free from coercion or undue influence. In Hanafi law, divorce during voluntary intoxication is valid.

  • Divorce can be oral or written, but Shia law requires oral Talaq in the presence of two witnesses.

Maintenance After Divorce

After a divorce, Khula, or mutual agreement (Talaq-e-Mubarat), the husband must provide maintenance (Nafaqah) to his wife during the Iddat period of three months.

If the wife is pregnant at the time of divorce, maintenance continues until the child is born.

If the wife is breastfeeding, the husband is required to continue maintenance until the child is fully weaned.

Conclusion

For overseas Pakistanis, divorce can be completed legally and efficiently with the help of a Special Power of Attorney. By following the proper steps and understanding how to send a divorce notice in Pakistan, overseas spouses can ensure a smooth, lawful, and timely divorce process.
